Affiliate Program Terms and Conditions

These Affiliate Program Terms and Conditions (“Terms”) govern participation in the Vittoria Greens Affiliate Program (“Program”) operated by Vittoria Greens Ltd, company number 16533375, registered at 32 Crescent Gardens, Newtown, United Kingdom, SY16 2HQ (“Vittoria Greens”, “we”, “us”, “our”).
By applying to join the Program, an applicant (“Affiliate”, “you”, “your”) confirms that they have read, understood and agreed to these Terms, together with the Vittoria Greens Privacy Policy and Website Terms and Conditions.
1. Eligibility and Registration
- The Program is open to individuals, content creators, influencers, bloggers, businesses, publishers and other suitable promotional partners.
- Applicants must provide accurate and complete information, including a valid email address and a website or social media profile through which they intend to promote Vittoria Greens.
- Submission of an application does not guarantee acceptance into the Program.
- All applications are subject to manual review and approval by Vittoria Greens.
- Vittoria Greens may accept or reject any application at its reasonable discretion and may request additional information before approving an Affiliate account.
- An Affiliate may not create multiple accounts for the purpose of obtaining additional commissions, discounts or other benefits.
2. Affiliate Links, Promotional Codes and Tracking
- Once approved, the Affiliate will have access to an Affiliate Dashboard and may generate personal referral links to the Vittoria Greens Website, products or promotional campaigns.
- Vittoria Greens may also assign a unique promotional or discount code to an Affiliate.
- Purchases made using an Affiliate’s valid promotional code may be attributed to that Affiliate in accordance with the tracking functionality of the Website.
- Affiliate referral tracking uses a 30-day attribution period.
- Where permitted by the visitor’s cookie preferences, an Affiliate tracking cookie may remain active for up to 30 days following a qualifying referral.
- Tracking cannot be guaranteed where a visitor blocks, rejects or deletes cookies, uses privacy or tracking-prevention technology, changes device or browser, or where another technical circumstance prevents reliable attribution.
- Affiliates must not manipulate, interfere with, conceal or attempt to circumvent the Website’s tracking system.
3. Affiliate Commission
- The standard Affiliate commission is 8% of the qualifying product value of an eligible completed order unless a different commission rate has been agreed in writing between Vittoria Greens and the Affiliate.
- Commission is calculated on the value of eligible products after all discounts, coupons and promotional codes have been applied.
- The following are excluded from the commission calculation:
- delivery and shipping charges;
- VAT, where applicable;
- refunded amounts;
- cancelled orders;
- failed payments;
- chargebacks;
- returned products;
- any other amounts not ultimately retained by Vittoria Greens as payment for eligible products.
- Where only part of an order is refunded, the Affiliate commission will be adjusted proportionally to reflect the final eligible order value.
- A commission becomes approved only after the relevant order has been successfully paid, fulfilled and accepted as a qualifying completed order.
- If a refund, cancellation, chargeback or other reversal occurs after commission has already been recorded or paid, Vittoria Greens may reverse the relevant commission or deduct it from future Affiliate earnings.
- Affiliates are not entitled to earn commission on their own purchases, purchases made on their behalf, artificial transactions or transactions created primarily for the purpose of generating Affiliate commission.
4. Payments
- Approved commissions will be shown in the Affiliate Dashboard as unpaid earnings until payment is processed.
- Affiliate payments are processed once per calendar month.
- The minimum payout amount is £20.
- Where an Affiliate’s approved unpaid balance is less than £20, the balance will automatically or administratively be carried forward to the next payment period until the minimum payout threshold is reached.
- Payments may be made by bank transfer or another payment method approved by Vittoria Greens.
- The Affiliate is responsible for providing accurate payment details.
- Each Affiliate is responsible for declaring and paying any personal, corporate or other taxes applicable to Affiliate income in their own jurisdiction.
5. Promotional Activities
- Affiliates may promote Vittoria Greens through legitimate channels including websites, blogs, social media, video platforms, newsletters and other approved marketing channels.
- Affiliate marketing must be honest, accurate and must not mislead consumers.
- Affiliates must not:
- use spam or unsolicited bulk communications;
- create fake accounts, fake reviews or fictitious transactions;
- impersonate Vittoria Greens or claim to be an employee, representative or authorised agent of Vittoria Greens;
- make misleading statements about products, prices, discounts or availability;
- register domain names or social media accounts designed to impersonate Vittoria Greens;
- manipulate referral tracking;
- engage in cookie stuffing or similar practices;
- use deceptive redirects or forced clicks;
- encourage fraudulent purchases;
- publish content that could reasonably damage the reputation of Vittoria Greens.
6. Paid Advertising and Brand Protection
- Unless Vittoria Greens provides prior written permission, Affiliates must not bid on or purchase paid advertising keywords containing: Vittoria Greens, variations or misspellings of the Vittoria Greens name, Vittoria Greens product names, domain names or other protected brand terms.
- Affiliates must not create paid advertisements that could reasonably lead consumers to believe that the advertisement has been placed directly by Vittoria Greens.
- Affiliates must not use the Vittoria Greens name in domain names, account names or advertising in a misleading or unauthorised manner.
7. Advertising Disclosure and UK Compliance
- Affiliates are responsible for ensuring that their promotional content complies with applicable UK advertising requirements, including the CAP Code, relevant ASA guidance, consumer protection requirements and any rules applicable to the platform on which the content is published.
- Where content contains an Affiliate link, personalised promotional code or other Affiliate arrangement from which the Affiliate may earn commission, the commercial nature of the content must be clearly and prominently disclosed.
- Where required, Affiliates should clearly identify relevant content as advertising, for example by using “Ad” prominently and before consumers engage with the advertising content.
- Abbreviations or unclear disclosures that consumers may not understand should not be relied upon as the sole indication that content is advertising.
Affiliate marketing involving personalised links or codes is treated as advertising by the ASA/CAP, and both the Affiliate and the brand may be responsible for compliance. Current ASA guidance recommends that advertising content be obviously identifiable before the consumer engages with it.
8. Food, Nutrition and Health Claims
- Affiliates must not make medical, therapeutic or disease-prevention claims about Vittoria Greens products unless such claims have been expressly authorised by Vittoria Greens and are legally permitted.
- Affiliates must not claim or imply that a Vittoria Greens product can diagnose, treat, cure or prevent a disease or medical condition.
- Affiliates must not create or publish unauthorised nutrition or health claims regarding Vittoria Greens products.
- Where Vittoria Greens provides approved product descriptions, nutritional information or authorised marketing claims, Affiliates should use those materials accurately and without exaggeration.
This is particularly important for Vittoria Greens because the CAP Code allows nutrition and health claims for food only where the relevant requirements are satisfied and the claim is authorised under the applicable regime.
9. Intellectual Property
- Vittoria Greens retains all rights in its trademarks, logos, photographs, product descriptions, graphics and other intellectual property.
- Approved Affiliates may use marketing materials specifically supplied or authorised by Vittoria Greens solely for the purpose of participating in the Program.
- Affiliates may not materially modify Vittoria Greens branding, logos or official marketing materials without prior permission.
- Participation in the Program does not transfer ownership of any Vittoria Greens intellectual property to the Affiliate.
10. Discounts and Promotional Codes
- Any Affiliate promotional code remains the property of Vittoria Greens and may be modified, suspended or withdrawn where reasonably necessary.
- Affiliates must accurately state the value, duration and conditions of any promotional offer.
- Affiliates must not advertise an expired discount or represent a temporary offer as permanent.
- Affiliates may not create unauthorised Vittoria Greens discount codes or make promises concerning discounts that have not been approved by Vittoria Greens.
11. Fraud and Abuse
- Vittoria Greens may review Affiliate traffic, referrals, purchases and transactions for suspected fraud or abuse.
- Vittoria Greens may withhold commission while potentially fraudulent activity is investigated.
- Commission generated through fraud, manipulation, self-referral, fake transactions or other prohibited conduct will not be payable.
- Serious or repeated abuse may result in immediate termination of the Affiliate account.
12. Relationship Between the Parties
- Participation in the Affiliate Program does not create an employment relationship, partnership, joint venture, franchise or agency relationship between the Affiliate and Vittoria Greens.
- Affiliates operate as independent participants and have no authority to enter into agreements or make commitments on behalf of Vittoria Greens.
- Affiliates are responsible for their own business activities, equipment, expenses, tax obligations and regulatory compliance.
13. Suspension and Termination
- An Affiliate may request termination of their participation in the Program at any time.
- Vittoria Greens may suspend or terminate an Affiliate account where the Affiliate:
- breaches these Terms;
- engages in fraud or suspected abuse;
- repeatedly publishes misleading or non-compliant advertising;
- makes unauthorised health or medical claims;
- damages or is reasonably likely to damage the reputation of Vittoria Greens;
- breaches applicable law or advertising regulations.
- Valid approved commission earned before termination will remain payable, subject to these Terms, except where the commission resulted from fraud, abuse, prohibited activity or transactions that subsequently became invalid.
- Affiliate links, codes and access to the Affiliate Dashboard may be disabled following termination.
14. Changes to the Program
- Vittoria Greens may reasonably amend the Program, commission rates, attribution period, payment rules or these Terms from time to time.
- Material changes will be communicated to Affiliates or published on the Website before or when they take effect, where reasonably practicable.
- Changes will not retrospectively remove valid commission already approved before the effective date of the change, except where required to correct fraud, errors, refunds or invalid transactions.
- Continued participation in the Program after revised Terms take effect constitutes acceptance of the updated Terms.
15. Availability and Tracking
- Vittoria Greens will take reasonable steps to maintain the Website and Affiliate tracking functionality but does not guarantee uninterrupted availability.
- Vittoria Greens is not responsible for lost attribution caused by circumstances outside its reasonable control, including browser restrictions, rejected cookies, deleted cookies, third-party software, device changes or internet service failures.
- Where a tracking dispute arises, Vittoria Greens may review available Website, order and Affiliate records and make a reasonable determination based on the available evidence.
16. Data Protection and Cookies
- Personal information relating to Affiliates will be processed in accordance with the Vittoria Greens Privacy Policy and applicable UK data protection requirements.
- Affiliates must comply with applicable data protection and privacy laws when collecting or processing personal information in connection with their promotional activities.
- Affiliate tracking may involve the use of cookies or similar technologies. Tracking remains subject to the Website visitor’s applicable privacy and cookie choices.
17. Liability
- Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
- Vittoria Greens will not be responsible for indirect or consequential losses arising solely from participation in the Program where such exclusion is permitted by law.
- Vittoria Greens does not guarantee any particular level of traffic, sales, commission or Affiliate income.
18. Governing Law
- These Terms and any dispute arising from participation in the Program are governed by the laws of England and Wales.
- The courts of England and Wales will have jurisdiction in relation to disputes arising under these Terms, subject to any mandatory legal rights that apply.
